Terms of Service Legal Agreement

Please read these terms of service carefully before using our platform.

1. Service Overview

Kerbes is an online platform dedicated to OSINT (Open-Source Intelligence).

The platform is owned and operated by Kecs LLC, a company incorporated in the State of Wyoming, United States (see Section 12, "Governing Law").

It provides tools, resources, and services designed for the analysis and correlation of publicly available information.

Access to and use of the platform are strictly reserved for individuals of legal age and full legal capacity.

By accessing or using Kerbes, you agree to be bound by these Terms of Service in their entirety.

Kerbes operates under an ethical and professional framework: its tools are developed to support security, transparency, and legitimate open-source research, while respecting fundamental rights and personal privacy.

2. Authorized Use and Restrictions

By using Kerbes, you agree to:

  • Use the platform solely for lawful, ethical, and professional purposes.
  • Not use Kerbes for illegal, defamatory, discriminatory, or privacy-infringing activities.
  • Not extract, reproduce, modify, or redistribute any tools, data, or content without prior written authorization.
  • Respect the privacy and dignity of individuals whose information may appear in open sources.
  • Not resell, commercialize, or exploit the results produced by the platform without Kerbes' formal approval.

Any misuse, abuse, or violation of these conditions may result in the immediate suspension or permanent termination of your account without notice.

3. Intellectual Property

Unless otherwise stated, all content, scripts, databases, interfaces, graphical elements, and technical tools available on the Kerbes website are the exclusive property of their creators and rightful owners.

Any reproduction, modification, distribution, or reuse, whether partial or total, without express written permission from Kerbes, is strictly prohibited.

Users retain ownership of the files or data they upload or process through the platform.

However, they grant Kerbes a limited, non-exclusive, and temporary license to use such data solely for technical and operational purposes necessary to provide the service.

4. Disclaimer and Limitation of Liability

Kerbes provides analytical and aggregation tools exclusively for educational, professional, research, or defensive cybersecurity purposes.

The information obtained through the platform originates from publicly available sources and does not constitute legal proof or certification.

The interpretation and use of results are the sole responsibility of the user.

Kerbes shall not be held liable for any direct or indirect damages, whether material or immaterial, resulting from:

  • The use or misuse of the platform,
  • The accuracy or reliability of third-party data sources, or
  • Any harm caused to third parties as a result of user actions.

Kerbes does not guarantee the complete absence of errors, interruptions, or vulnerabilities but implements advanced measures to minimize such risks.

5. Lawful and Ethical Use

Kerbes is strictly intended for lawful and legitimate activities.

It must not be used to:

  • Collect non-public data,
  • Bypass security measures,
  • Profile individuals without legal basis, or
  • Interfere with third-party information systems.

The user acknowledges that any abusive, intrusive, or unlawful use of the platform may result in civil or criminal prosecution, depending on the severity of the misconduct.

6. Cooperation with Authorities

Kerbes reserves the right to cooperate with competent authorities in the event of any report, investigation, or legal request related to illegal or unethical use of the platform.

In cases of suspected unlawful activity, Kerbes may immediately suspend the concerned account and share relevant technical information with authorities, in accordance with applicable legal obligations.

7. Data Protection and Privacy

Kerbes is committed to maintaining confidentiality and protecting user data.

No personal data is collected or stored beyond what is strictly necessary for the operation of the service.

All analyses and tools are based solely on information that is publicly available (open sources).

No data is enriched, cross-referenced, or used for profiling, targeting, or surveillance purposes.

Kerbes employs advanced security standards to ensure system integrity and protect the confidentiality of processed data.

8. System Security and Integrity

Users agree not to:

  • Circumvent or attempt to bypass security mechanisms,
  • Interfere with the normal functioning of the platform,
  • Perform reverse engineering, or
  • Conduct vulnerability or penetration testing on the platform.

Any attempt to compromise, alter, or disrupt the service is strictly prohibited and may result in legal action.

9. Service Modifications and Force Majeure

Kerbes reserves the right to modify, suspend, or temporarily interrupt its services at any time, including for maintenance, technical improvements, or force majeure circumstances.

Kerbes shall not be held liable for any consequences arising from such interruptions or modifications.

10. User Acknowledgment

By creating an account and using the platform, the user acknowledges having read, understood, and accepted these Terms of Service in full.

The user certifies that they are using Kerbes within a legal, professional, and ethical framework and understands that any violation of these provisions may lead to the permanent suspension of their access.

11. Payments, Credits, and No-Refund Policy

Kerbes is a prepaid, fully digital service. Credits are a limited, prepaid right of access to the platform's search and analysis functions. Credits are not money, not a deposit, and hold no monetary or cash value; they are non-transferable, non-exchangeable, and cannot be converted back into any currency.

All sales are final. By completing any payment, the user expressly and irrevocably acknowledges and agrees that:

  • Every purchase of credits is final and non-refundable, whether or not the credits are ever used — in whole or in part. No refund, credit-back, or reimbursement of any kind will be issued for unused, partially used, or fully used credits, for any reason whatsoever.
  • Because the purchase grants immediate access to digital content and functionality, the user requests immediate performance of the service and expressly waives, to the fullest extent permitted by applicable law, any right of withdrawal, cancellation, "cooling-off" period, or reimbursement that might otherwise apply to online or distance purchases.
  • No refund will be granted on the basis of change of mind, dissatisfaction with the results, misunderstanding of the service, failure to use the credits, voluntary closure of the account, or suspension or termination of the account for any breach of these Terms. Credits remaining on a suspended or terminated account are forfeited without refund.
  • No chargeback, payment reversal, or bank or card dispute will be tolerated. Any such dispute constitutes a breach of these Terms and will be treated as fraudulent ("friendly fraud"). Kerbes will contest every dispute with full technical evidence, including authentication logs, IP addresses, device information, timestamps, and proof of service availability, account activity, and delivery.

By purchasing credits, you confirm, in full knowledge and with your express consent, that you have read, understood, and accepted this no-refund policy; that all sales are final regardless of whether the credits are ever used; and that you irrevocably waive any refund claim, complaint, or dispute in connection with your purchase. Any attempt to obtain a chargeback or refund after purchase will result in the immediate and permanent termination of your account, denial of service across all related identifiers and payment methods, reporting to fraud-prevention and chargeback networks, and recovery of all associated costs, fees, and losses.

12. Governing Law, Jurisdiction, and Dispute Resolution

The Kerbes platform is owned and operated by Kecs LLC, a limited liability company organized and existing under the laws of the State of Wyoming, United States of America.

These Terms of Service, and any dispute or claim arising out of or in connection with them, their subject matter, or their formation — including the purchase and use of credits — are governed by and construed in accordance with the laws of the State of Wyoming and the applicable federal laws of the United States, without regard to conflict-of-law principles and without application of the consumer-protection, distance-selling, or right-of-withdrawal rules of any other country.

The user and Kecs LLC agree that the state and federal courts located in the State of Wyoming, United States, shall have exclusive jurisdiction and venue over any dispute that is not otherwise resolved. Each party irrevocably submits to that jurisdiction and waives any objection based on inconvenient forum or venue.

To the fullest extent permitted by law, the user waives the right to a trial by jury and the right to participate in any class, collective, or representative action. All disputes must be brought solely in the user's individual capacity.

These Terms are drafted in English, which is the sole controlling language. Any translation is provided for convenience only and has no legal effect.

13. Entire Agreement, Severability, and Amendments

These Terms of Service constitute the entire agreement between the user and Kecs LLC regarding the use of the platform and supersede any prior understanding, representation, or agreement.

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions — including, in particular, the no-refund and no-chargeback provisions of Section 11 — shall remain in full force and effect.

Kerbes reserves the right to modify these Terms at any time. Continued use of the platform after any update constitutes acceptance of the revised Terms. The version of these Terms in force at the time of each purchase governs that purchase.
